What to do if your tenant wants to leave before the lease ends

Your tenant has the right to end their lease at any time, without giving a reason. They must give 3 months’ notice for an unfurnished rental (reduced to 1 month in a high-demand area (zone tendue, a large urban area where the rental market is especially tight) or in specific cases) and 1 month for a furnished rental, delivered by registered letter, by hand against a signature, or by a court bailiff’s deed (acte de commissaire de justice). The tenant’s rights: they can leave, but not without warning
Your tenant has the right to end their lease whenever they like, even without a reason. They still have to respect:
- a 3-month notice period for an unfurnished rental, reduced to 1 month in a high-demand area or in specific situations (job transfer, job loss, health reasons, domestic violence, first job, social housing allocation, receiving the RSA or AAH benefits);
- a 1-month notice period for a furnished rental, with no justification required;
- formal delivery: registered letter with return receipt, hand delivery against a signature, or a court bailiff’s deed.
So they can’t just walk out on you without notifying you properly.
Their obligations: they can’t just vanish
Even if they move out early, your tenant still has a few duties:
- pay rent until the end of the notice period, unless a new tenant moves in before then;
- attend the move-out inspection to avoid disputes, a topic on which many owners end up in disagreement;
- officially hand back the keys, usually at the time of the inspection.
Your rights and obligations as an owner
You have responsibilities too:
- accept their notice: you can’t object, it’s the law;
- carry out the move-out inspection: if you disagree, call in a court bailiff (commissaire de justice);
- re-rent quickly: as soon as a new tenant moves in, the previous one no longer owes rent.
You can start work before the notice period ends, but your tenant still has to pay rent until the official date. And if the home isn’t returned in the condition it was handed over in, here’s what you can do.
What if the tenant leaves before the notice period ends?
They can move out earlier, but they remain liable for rent until the end of the notice period, unless you find a new tenant in the meantime. If a disagreement comes up over the inspection report or the departure date, you can consult a professional to avoid misunderstandings, as with any breach of the lease terms.

- talk with your tenant, since good communication prevents a lot of problems;
- keep all the evidence (notices, inspection report) to protect yourself if something goes wrong;
- plan ahead and start looking for a new tenant as soon as possible;
